NaviShark Terms of Service

Effective Date: Jan 1, 2025

Welcome to the digital promotion and engagement services provided by NaviShark. In order to protect the rights and obligations between you and us and to ensure service transparency and consistency, please carefully read the following Terms of Service (hereinafter referred to as “these Terms”) before using this website and related services. By accessing, registering, placing an order, or using our services, you are deemed to have read, understood, and agreed to all contents of these Terms. If you do not agree to any part of these Terms, please cease use of the website and its services.

1. Service Description

NaviShark provides a suite of digital interaction services operating via the internet and social media platforms. These services aim to increase users' online visibility and engagement and include, but are not limited to: boosting video views, increasing follower counts, likes, comments, and other interactions. In most cases, such services are executed immediately upon order placement and are classified as real-time digital products that cannot be paused or reversed.

The functionality of these services depends on third-party platforms (e.g., Facebook, YouTube, Instagram, TikTok). NaviShark is not officially affiliated with or endorsed by any such platforms and holds no control over them. As such, NaviShark cannot guarantee the platforms' operational stability, policy continuity, or future changes.

2. User Obligations

As a user, you agree to use our services lawfully and in good faith, complying with the usage rules and content policies of third-party platforms (e.g., social media sites). You must ensure that any information you provide (such as video links or profile URLs) is accurate and free from illegal, false, or offensive content.

If your use of our service violates the terms of any third-party platform or causes your account to be restricted, suspended, have content removed, or otherwise penalized, NaviShark assumes no legal or financial responsibility. All such risks and consequences are to be borne by you.

Additionally, you agree not to use our services for any form of fraud, algorithm manipulation, malicious content distribution, or other improper purposes. If found in violation, NaviShark reserves the right to terminate services immediately without refund.

3. Account & Security

Certain services may require you to create an account for order management and access to order history. You must provide accurate, complete, and current information during registration. If you provide false or misleading data, NaviShark reserves the right to suspend or terminate your account and cancel any pending orders.

You are responsible for keeping your login credentials secure and must not share them with others. If you suspect unauthorized use of your account, please notify us immediately so we may take protective action. NaviShark is not liable for any loss arising from account misuse.

4. Fees & Payment

All service prices are clearly listed on the website or order page. Users must confirm the service details, pricing, and estimated delivery time before submitting an order. Accepted payment methods may include, but are not limited to: credit cards, cryptocurrencies, or third-party payment tools.

Orders will be processed only after payment is confirmed. Due to the nature of our services as digital products executed immediately upon payment, all orders are final and non-changeable. Users cannot request to change order details, such as target links or recipient profiles, after submission. Please verify all information before placing your order.

5. Subscriptions & Auto-Renewals

Some services offered by NaviShark operate on a subscription basis (e.g., monthly renewals, automatic top-ups, recurring traffic growth). These services will automatically charge your designated payment method upon the end of each billing cycle. Unless canceled in accordance with these terms, you are deemed to have agreed to the automatic renewal and applicable charges.

If you wish to cancel your subscription or stop auto-renewals, you must contact NaviShark customer support at least 48 hours (2 full calendar days) prior to your next billing date and clearly request cancellation. Please refer to the official contact details published on our website and retain a copy of your cancellation request as proof.

If you fail to complete cancellation within the specified timeframe, your subscription will be renewed and the charge processed accordingly. Once charged, the subscription is considered active, non-cancellable, and non-refundable (see Refund Policy).

Some payment platforms (e.g., credit cards or PayPal) may offer additional subscription management tools, but cancellations must still be submitted through NaviShark's official support channel. NaviShark is not responsible for unintended renewals caused by user error or failure to follow cancellation procedures.

6. Refund Policy

Due to the real-time nature of our digital services, which are system-automated and irreversible once processing begins, all sales are final and non-refundable. This strict no-refund policy helps preserve the integrity of automated workflows and prevent order abuse or fraud.

Refunds will not be granted under any of the following (including but not limited to):

  • User provided incorrect or invalid video/account links;
  • Content violated platform policies and was removed, blocked, or limited in visibility;
  • User is dissatisfied with perceived performance or outcomes;
  • Changes in third-party algorithms, systems, or rules cause service interruptions or deviations;
  • Claims that the order was unauthorized or placed by mistake.

All orders are considered deliberate and fully understood by the user at the time of placement. By placing an order, you unconditionally accept this Refund Policy. NaviShark retains the sole right to deny any refund request, without obligation for further explanation.

If consumer protection laws in your jurisdiction mandate a different refund standard, such mandatory provisions shall apply only to the minimum extent required by law.

7. Disclaimer of Warranties

All services provided by NaviShark are offered “as-is” and “as available.” We do not guarantee specific outcomes or commercial results from using our services. We make no warranties—express or implied—regarding data performance, reach, or user engagement generated by our services.

We are not responsible for delays, disruptions, or performance changes caused by platform policy updates, algorithm modifications, review systems, third-party interference, or any other factors outside our control.

8. Limitation of Liability

To the maximum extent permitted by law, NaviShark shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from your use of, inability to use, or reliance on our services. This includes (but is not limited to) business losses, lost profits, data loss, account suspensions, or third-party complaints.

By using our services, you acknowledge and accept these risks as your own responsibility.

9. Intellectual Property

All content on this website—including but not limited to design, trademarks, trade names, images, interfaces, videos, scripts, and code—is the property of NaviShark or is legally licensed and protected under applicable intellectual property laws.

You may not copy, distribute, modify, publicly broadcast, or use any such materials for commercial purposes without prior written authorization. Violations may result in legal action.

10. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, excluding its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall first be resolved via written negotiation. If negotiation fails, both parties agree to binding arbitration in London, UK, under a legally recognized arbitration body.

The arbitration result shall be final and binding upon both parties.

11. Legal Costs & Enforcement

If NaviShark must take legal action to assert its rights or seek compensation due to your breach of these Terms, you shall compensate NaviShark for all reasonable expenses incurred—including but not limited to attorney fees, litigation costs, notarization fees, and enforcement costs.

This obligation applies regardless of the outcome of the dispute and extends to pre-litigation stages such as legal consultations or official notices.

12. Amendments & Updates

NaviShark reserves the right to modify, supplement, or update these Terms at any time without prior notice to individual users. The latest version will be posted on the website and shall become effective upon publication. Continued use of our website or services constitutes your acceptance of the updated Terms.

13. Prohibition of Abuse of Refunds, Complaints, and Arbitration

Users shall not abuse refund requests, complaint filings, dispute resolutions, or arbitration procedures in any manner, including but not limited to submitting false, misleading, or fraudulent information, repeatedly making malicious refund requests, or initiating legal actions without reasonable grounds or factual basis.

If such abuse is confirmed, NaviShark reserves the right to immediately terminate the user's service privileges and reject such refund requests, complaints, and arbitration demands. Furthermore, users shall be liable for all reasonable costs incurred by NaviShark as a result of such abuse, including attorney's fees, litigation expenses, and other related costs.

NaviShark reserves the right to take legal action against such abusive conduct and shall not waive any rights by virtue of any refund requests or dispute proceedings.
